General Terms and Conditions of Sale
These General Terms and Conditions of Sale (hereinafter the "Terms") govern the relationship between Borasol SARL and any client booking a room, a table, the park, or the event hall at the Borasol estate located on Route de Rabat km 17, Tanger, Morocco. Placing a reservation implies full and unreserved acceptance of the present Terms.
1. Definitions
"Borasol" refers to Borasol SARL, operator of the hotel, restaurant, park and event hall at Route de Rabat km 17, Tanger. "Client" refers to any natural or legal person making a reservation for one of the services offered. "Services" refers to overnight accommodation, restaurant meals, access to the park, and the rental of the event hall, together with any associated services explicitly listed in the booking confirmation.
2. Prices
All prices are quoted in Moroccan Dirhams (MAD), all taxes included, and reflect the rates in force on the day of the reservation. The local tourist tax (taxe de promotion touristique) is added per person per night where applicable. Borasol reserves the right to adjust its public rates at any time; the rate applicable to a confirmed reservation is the one shown on the written confirmation.
3. Reservation procedure
Reservations may be made by telephone at +212 8 08 55 43 19, by e-mail at [a completer], or through the website. A reservation is only firm once Borasol has sent a written confirmation, normally within twenty-four (24) hours of the request. The Client is responsible for the accuracy of the information provided at the time of booking.
4. Deposit and payment
For room and restaurant reservations, payment is made on arrival or at the end of the stay, by cash, bank card, or any other means accepted at reception. For event hall rentals and group bookings, a deposit of thirty percent (30%) of the total amount is required to confirm the reservation, with the balance due no later than the day of the event. Borasol may, at its discretion, request a credit card guarantee to secure individual room bookings.
5. Cancellation and modification
Individual room reservations may be cancelled or modified free of charge up to forty-eight (48) hours before the announced arrival date. Beyond that deadline, the first night will be charged as compensation. Event hall and group reservations may be cancelled free of charge up to seven (7) days before the event; between seven (7) and two (2) days before the event, the deposit is retained; less than forty-eight (48) hours before the event, the full amount is due. No-shows are charged in full.
6. Arrival and departure
Rooms are available from 2:00 p.m. on the day of arrival and must be vacated by 12:00 noon on the day of departure. A late check-out may be arranged subject to availability and may give rise to an additional charge. A valid identity document is required at check-in for each adult guest, in accordance with Moroccan regulations.
7. House rules
Clients undertake to use the premises peacefully and to respect other guests, staff, and the surrounding natural environment of the park. Pets are admitted only with prior agreement. Smoking is prohibited inside the buildings. Borasol reserves the right to refuse access to, or to require the departure of, any person whose behaviour is contrary to public order, safety, or the tranquillity of the estate, without entitlement to any refund.
8. Liability
Borasol is bound by an obligation of means in the performance of its services. Its liability cannot be engaged in the event of theft, loss, or damage to personal belongings left in the rooms, vehicles, or common areas, except in cases of proven gross negligence. The Client remains liable for any damage caused by themselves or by persons under their responsibility to the premises, equipment, or plantings of the estate.
9. Force majeure
Neither party may be held liable for any failure to perform its obligations resulting from an event of force majeure within the meaning of Moroccan law and case law, including but not limited to natural disasters, fires, floods, strikes, decisions of public authorities, or health crises preventing access to the estate or the normal operation of the services.
10. Complaints
Any complaint relating to the performance of the services must be addressed in writing to Borasol within fifteen (15) days of departure, by e-mail at [a completer] or by post to Borasol SARL, Route de Rabat km 17, Tanger. Borasol undertakes to provide a reasoned response within thirty (30) days of receipt.
11. Applicable law and jurisdiction
The present Terms are governed by Moroccan law. In the absence of an amicable settlement, any dispute arising from their interpretation or performance falls within the exclusive jurisdiction of the competent court of Tanger (tribunal competent de Tanger).
